Sheila Polk is Yavapai’s first female County Attorney :: she’s currently serving her third term in that capacity. James Arthur Ray is Yavapai’s first guru of mass casualty causation :: and he might serve three terms himself.

Presented above is fourteen minutes of Ms. Polk’s terrific two-and-a-half hour closing argument.

    The plutonium comment would be hilarious, if this whole thing wasn’t so serious. JAR really needs to go to jail, and if the jury indeed “did not check their common sense at the door” then he will be doing another perp walk. Hope they do let Detective Diskin cuff him and walk him out.

    The defense contends that the victims were exposed to a toxic substance [[and they were]], but what may not have been conveyed very well to the jury, is that heat is a toxic substance.

    The problem is that the symptomology of heat illness [[or any toxic substance]], depends on the “level” of exposure [[and "inherent" organ "weaknesses"]], which will ultimately gives rise to the types of symptoms that will be seen.

    Clinical diagnosis [[especially with something like heat]] has to rely solely on “comparative analysis” based on past clinical data, which involves “normal” toxic levels of heat [[not "extreme" levels as the victims were exposed to]].

    Expose someone to 45C [[arbitrary temperature]] and you will see one set of symptoms, expose them to 55C and the very same person will not only display additional symptoms, but may otherwise not exhibit symptoms that are consistent with heat [[such as dehydration]], as normal physiological processes [[cooling]] do not have a chance to reach their ultimate conclusion [[dehydration]] before organ failure ensues, and the body begins to “shutdown”. That’s why some of these symptoms [[as organs "fail"]] appear to be signs of a toxin [[other then heat]], and why doctors don’t agree.

    I hope that the jury looks at the lack of any corroborating evidence [[to support the idiotic theory being put out by the defense]], rather then the transparent spin that the defense has put out.

    This was not a typical case of non-exertional heatstroke. That can take days, like when elderly people don’t have AC. But these heat levels were extraordinary; far hotter than someone’s uncooled apartment on a hot, Arizona day. I doubt there would be much of anything to compare it to; a closed car on a hot day is about the closest. This was a really extraordinary circumstance and must have been very hard for those ER docs to wrap their heads around.

I think the most creepy thing is Li being touchy-feely with Ray, never all through these 4 months have we seen any thing close to that from any of the defense team members.

    Yes, I also found his sudden touchy-feely approach off-putting considering how for months they basically treated James like he was a leper and if they got too close they might get some of his rat poison Ebola bleed out Kooties on them. He might start channeling angels and whose knows what’s next? Talking to animals? It might cause their concrete brains to shatter.

    Li made a point of saying the prosecution kept referring to James as “the defendant” and he had a name. I was just thinking that when he was addressing the jury he never mentioned James Shore, Kirby and Liz. At the very end when he was finally wrapping it up I thought he might actually say their names, but then, that would humanize them too much to the jury and we can’t have that.

Like yesterday, he repeatedly refered to the prosecution as the ineffectual “government” which I see as a grave error.     I’m curious why you think so Jean. It has been many years since I lived in Yavapai County, but I tend to think there is a great deal of anti-government sentiment among the people there. Whether those people would be on the jury is another question.

He just kept talking about situations and things…not about what happened, tried to make everyone else look guilty and “the government” look like an evil entity who will interfere with everyone’s life if this jury convicts Death Ray.

    Plus he needs to see a speech therapist…his stuttering is really getting irritating.

    Since he did not really personalize any of it until the very, very end, I can’t imagine the jury letting him off the hook. They’re probably pissed off that he took so much of their time to say nothing.

    Anyone want to do an informal sports type bet (no money) to bet on how long it will take for a conclusion and what he will be charged with? I know this sounds stupid, but does it have to be unanimous? Or can it be a majority?

    I applaud Sheila Polk for making a linear and succinct wrap up of the testimony and feel she did a good job for the case against JAR. I can see where there were problems with her case composition and if heaven forbid this needs to be retried then hopefully some things can, should and will be corrected.

    Li on the other hand might have his closing backfire on him in many ways. His libertarian flavor pandering to the jury won’t play well for this case. I’m sure he feels he has done his homework to understand the predominant political leanings of this population where JAR is on trial, but that usually applies to the federal level of government and not so much to the local levels. People can and do support locally elected officials for the most part and don’t want to believe that there is a conspiracy against their constitutional rights from them.

    I did wonder at some point with Li’s take on the evidence that I may have witnessed a different trial from what Li attended. He cherry-picked his way through much of the testimony and recalled to the jury a great deal that was out of context. I think this will backfire because the jury was allowed to take notes and I’m counting on them having a better ability to remember testimony than Li did at obfuscating it.

    Then there was ( O M G !!!! ) Li’s infuriating delivery. The histrionics and the faux ‘folksy’ demeanor he spewed out had me off my feed for a few days. I’m sure he would like for the jury to think he’s everybody’s good neighbor but they know this guy is a high paid lawyer from LA with an ingratiating manner that is nauseating. He wasted hours for them with his personal stories and stupidly constructed metaphors. I think that won’t be lost on them either.

    Finally there was the hypocrisy. Li admonishing the jury not to hold JAR’s beliefs against him with such things as his ‘prayer’ of “I am the Alpha/Omega blah blah blah” and his “teachings” but then in the same day mocking the Hamiltons and Fawn Foster for their beliefs.

    I myself want to believe that Li’s filibuster of a close is a blessing in disguise. I’m hoping that it will fade with any impact it may have had over this long weekend and come Tuesday Sheila will have ample and equal time to counter all of Li’s ridiculous points with a lucid delivery of facts gleaned from all the witness testimony. I saw that she took plenty of notes herself.

    Unfortunately the jury will never know until the trial is complete of the underhanded tactics in the blocking of some pertinent facts to this case. Once they discover this and depending on the verdict will have them knowing the distasteful practice of the best in a sleazy defense lawyer who really doesn’t do criminal law at all but does self-promotion as a Corporate Crisis attorney.
    What a noble and satisfying practice that must be.

    You were right on in saying that Li’s attack on “the government” was misconceived. One legitimate function of government is to protect the people from harm. I do not believe Republicans, Libertarians, nor any other group holds that freedom gives us the right to harm others and walk away with impunity. His inane comments and posturing make me think, on occasion, as others have mentioned, that he detests his client as much as we do and hope our ire at him transfers to his slimy client, even though his client hangs himself on his own behavior.

Also virtually all of the witnesses came across as sympathetic, except Dr Paul. The one who came across uncaring and cruel is Ray, typified by (but obviously not limited to) his post death-lodge behavior. And the defense team as well. They taunted and made fun of witnesses and overall gave them a hard time. So the trying to portray the prosecution as “the government trying to take away Mr Ray’s rights” will be a tough sell.

    I think Li’s desperation and the over-kill of his arguments could backfire as well, coming across as necessary only because Ray has no defense.

    I hope that the whole toxins nonsense will backfire on them. They repeatedly and smugly told the jury they don’t need to prove it, openly admitting it’s a ruse and implying the jury is duty bound to play along with it.

    But the fact that such measures are necessary could easily be taken by the jury to show further knowledge of guilt. Sheila did a great job of listing all the theories, and finishing the list with the infamous “It was Ted” line.

    Maybe they should have allowed the state to bring in as much evidence as they wanted, including his actions at other (non-sweat lodge) events, and finances etc etc, and then just shot it all down on the same grounds they used to get it excluded, and just kept repeating he didn’t know, he didn’t know he didn’t know.

    I suspect they didn’t try that because Ray was hoping to get let off with his reputation still in tact enough to continue his business.

The difference was the people running it really knew what they were doing. It was led by a terrific native american guy, who did a great job. There were four rounds, not eight. Everyone exited the lodge after each round. It was necessary to cool down, hydrate and allow one’s heart rate to come down a bit. There were a total of 42 stones, so each round got hotter and hotter. By the fourth round, there was no way I could sit up. I had to lie down and focus
    on breathing. It felt really good when it was over!

    Afterwards, I asked my young friend if he could imagine staying in the lodge without coming out for all four rounds? I was not surprised when he said; “dude there’s no way I could’ve made it!” I had to completely agree.

    It was an amazing experience, that is not for the faint at heart. Having gone through it, I can not imagine what those poor people in Sedona were subjected to. Cruel and unusual punishment is a gross understatement.
    I can also understand now how people were unable to help anyone else. They had to be toast themselves by the second round. Beyond that, I have no idea how bad it must have been for them.

    Oh yeah, the cost was $12.00, which went to the facility, plus a optional donation to the very qualified person leading the ceremony.

    What I came away thinking was, if the jury attended a “real” sweat lodge and compared it to what Death Ray was putting his attendees through, they would surely convict him of the most serious charges.

    The cost for Spiritual Warrior was ridiculous and obscene. What that guy perpetrated on his customers was beyond criminal.

    @Mario, Thanks for your description of a real sweat lodge. I had some heat related stress a few years ago so I avoid would that experience like the plague. What stunned me is the fact you had to leave during each round, how smart that was and how greedy and wrong JAR was. How easy that would have been, what a difference that could have made.

    @Mario, From what I’ve learned of legitimate sweat lodges during this trial, what you experienced is the usual way of doing things. Which underscores once again how Ray upped the ante on purpose and deliberately made things more extreme, and thus dangerous. In addition to not letting people out between rounds as a matter of course, he doubled the rounds, upped the number of rocks and water exponentially, and had the ceiling lowered, all in his effort to make this the most extreme experience out there, which he stated was his goal, and he crowed about it.

    @Mario,…Having done many lodges myself, I have said from the begining it was arrogance and ignorance that ran that deadly lodge. Ray was ignorant of knowledge in what a sweat lodge truely is, and he was arrogant in doing what he had no knowledge of. I am more than willing to bet that the sweat lodge keeper you had never stated he was the “Alpha and the Omega, I am god”…Ray tried to incorporate many different beliefs inside that lodge, because he was lacking in knowledge of what a lodge is. It is a sweat lodge keeper, not a lodge “master” inside the lodge. A sweat lodge keeper is not a “master”, they are there as servants of the people. Remember , Ray told one participant to “go where you are” if a bathroom break was needed. Ray was never, for even one moment, a sweat lodge keeper. What Ray was, and is, is 50 lbs. of crap in a 10 lbs. bag.
